Job Description:
Overview
The India HR Compliance Background Investigations Analyst will play a vital role in leading compliant, risk-based background check screening processes while ensuring adherence to applicable employment laws and data privacy regulations. As part of the Background Investigations team, this role serves as a subject matter expert on background investigations and hiring compliance, partnering cross-functionally to manage risk, interpreting complex findings, and upholding the firm’s regulatory and ethical standards. The role ensures consistent and timely execution of background investigations in accordance with applicable firm policies and screening requirements, while applying sound judgement to identify and appropriately escalate complex, ambiguous, and time-sensitive cases.
This position requires strong regulatory knowledge and critical thinking skills, analytical judgement, the highest level of confidentiality and discretion, and the ability to operate effectively and efficiently in a fast-evolving compliance landscape.
Key Responsibilities
Background Investigations
Coordinate and facilitate pre-employment background checks for India-based hires primarily, as well as internal promotions, contractors, and client-specific engagements.
Liaise with external background check vendors to ensure accurate, compliant, and timely processing of investigations.
Review and adjudicate background check results against firm standards and legal requirements, while applying sound risk-based judgement, and escalating complex findings as appropriate.
Partner with Talent Acquisition, HR Business Partners, and Legal to manage exceptions, escalations, and adverse action processes.
Continuously identify ways to enhance background investigation policies, controls, processes, vendor governance, and candidate experience.
Compliance Oversight
Maintain detailed knowledge and subject matter expertise in Indian employment and data privacy laws related to compliance with hiring and background investigations (e.g., Shops & Establishments Acts, Aadhaar restrictions, Digital Personal Data Protection Act (DPDP), as well as knowledge of relevant U.S. and global regulations (e.g., Fair Credit Reporting Act (FCRA), Fair Chance Acts, GDPR, etc.).
Monitor legislative changes and emerging industry risks impacting hiring compliance.
Identify and proactively recommend controls to mitigate evolving risks within the hiring and background screening landscape including resume fraud, credential misrepresentation, synthetic identities, AI-enabled candidate impersonation, automated application bots, and misuse of generative AI during interviews.
Ensure compliance with all applicable laws and regulatory requirements related to pre-employment processes and adverse action.
Training & Education
Develop and deliver training for HR teams, hiring managers, and other stakeholders on background check processes and compliance obligations.
Act as a trusted advisor on compliance best practices to minimize organizational risk.
Documentation & Reporting
Maintain complete, accurate, and audit-ready background check records, communications, and compliance documentation.
Prepare reports and dashboards on compliance activities, background check trends, audit findings, and metrics.
Communication
Provide clear, timely, and relevant communication to candidates, employees, and other key stakeholders regarding background check results and compliance requirements.
Handle all background check reports and sensitive information with the highest level of discretion, confidentiality, and professionalism, and on a strict need-to-know basis.
Qualifications & Requirements
Education & Experience
Bachelor’s degree in Human Resources, Business Administration, Legal Studies, or related field.
3–5+ years of relevant HR compliance, background investigations, or related experience.
Experience within professional services, consulting, or multinational organizations preferred.
Specialized Knowledge
Strong knowledge of employment law, compliance frameworks, and regulatory requirements.
Sound understanding and familiarity with Shops & Establishments Acts, Aadhar regulations, FCRA, Fair Chance Acts, DPDP, GDPR, and global data privacy and compliance standards as it relates to employment and background investigations.
Experience with HRIS systems, applicant tracking systems, and background screening tools.

Preferred/Additional Requirements
Professional certification in HR compliance, employment law, or related field (e.g., HRCI, SHRM, XLRI, CCEP, etc.).
Demonstrated ability to manage sensitive investigations or escalations with discretion.
Global compliance experience (e.g., cross-border background checks and compliance).
Strong data analysis and reporting skills (Power BI, Tableau, or advanced Excel).
